A LLC is formed on the name of the property being acquired where Baniya Capital LLC becomes the primary active partner. Other partners are designated as passive or non operating partners via operating agreement.
During acquisition, Baniya Capital LLC takes care of forming the LLC, obtaining EIN, working with the realtor, seller and title company to ensure proper ownership.
Post acquisition, Baniya Capital LLC manages the property. This includes leasing out, collecting rents, handling day to day maintenance and support for the tenants, bookkeeping and so on.
We typically lock in a new acquisition for 5 years. In this period, the property cannot be sold unless all investors mutually agree.
There are possibilities for other investors to buy out your share during the locking period.
After initial locking period is over, the property could be locked again, sold by individual partners to other partners or could be liquidated subject to agreement of all the partners.
